EVIDENCE OF FLIGHT

 

            There has been evidence introduced in this case that (Def)_______________ left the scene.  Evidence of flight does not raise any presumption of guilt. It has very limited value as proof because, while it might show consciousness of guilt, flight is also consistent with innocent behavior, such as fear, panic, ignorance, confusion, unwillingness to confront the police, and reluctance to appear as a witness.  You should weigh this evidence along with all other evidence in the case and assign this evidence and the other evidence the relative weights you think appropriate. Flight evidence is not sufficient by itself to return a guilty verdict.
