SEQ CHAPTER \h \r 1CR10-811 (09/22/03)

Definition of “sudden passion” (context of manslaughter)

As used in this charge, the term sudden passion refers to such passion as would cause a reasonable person to act rashly and without reflection and deliberation, under the same or similar circumstances.  Sudden passion means that you find that (Def)_______________ acted or reacted from emotion and not from reason.  In considering whether (Def)_______________ reacted out of sudden passion, you should consider whether a reasonable, ordinary person if placed in (Def)_______________’s circumstances would have acted out of emotion and without thought or reason.
